Packaging and PPWR<\/h2>\n\n

\u00a71 Scope of Application<\/h3>\n\n

These provisions apply to all logistics services provided by
Logistik Centrum Hamburg Hinderer GmbH & Co. KG<\/strong> (hereinafter referred to as the \u201cContractor\u201d), in particular:<\/p>\n\n

    \n
  • Warehousing<\/li>\n\n
  • Transport logistics<\/li>\n\n
  • Shipping services<\/li>\n\n
  • Value Added Services (VAS), such as repacking, co-packing, and re-packaging<\/li>\n<\/ul>\n\n

    \u00a72 Packaging Responsibility<\/h3>\n\n

    (1) The Client is responsible for compliance with all legal requirements relating to packaging, in particular pursuant to the Packaging and Packaging Waste Regulation (PPWR).<\/p>\n\n

    (2) This includes in particular:<\/p>\n\n

      \n
    • the recyclability of packaging<\/li>\n\n
    • compliance with material requirements<\/li>\n\n
    • labeling and information obligations<\/li>\n\n
    • requirements regarding minimization and reusability<\/li>\n<\/ul>\n\n

      \u00a73 Performance of Packaging Services<\/h3>\n\n

      (1) Packaging services provided by the Contractor shall be performed exclusively:<\/p>\n\n

        \n
      • based on the Client\u2019s specifications; or<\/li>\n\n
      • using the Contractor\u2019s standardized packaging solutions.<\/li>\n<\/ul>\n\n

        (2) If no explicit Client specifications are provided, the Contractor shall be entitled to use suitable standard packaging at its own discretion.<\/p>\n\n

        \u00a74 Liability<\/h3>\n\n

        (1) Responsibility for the legal compliance of the packaging shall remain with the Client unless expressly assumed by the Contractor in written form.<\/p>\n\n

        (2) The Contractor shall not be liable for:<\/p>\n\n

          \n
        • the legal admissibility of packaging<\/li>\n\n
        • the Client\u2019s compliance with statutory packaging regulations<\/li>\n\n
        • incorrect or incomplete Client specifications<\/li>\n<\/ul>\n\n

          \u00a75 Value Added Services (VAS)<\/h3>\n\n

          (1) Services such as:<\/p>\n\n

            \n
          • repacking<\/li>\n\n
          • re-packaging<\/li>\n\n
          • co-packing<\/li>\n\n
          • kit assembly<\/li>\n<\/ul>\n\n

            shall be performed exclusively on the basis of the Client\u2019s specifications.<\/p>\n\n

            (2) In the absence of such specifications, the Contractor assumes no responsibility for packaging compliance.<\/p>\n\n

            \u00a76 Client\u2019s Duty to Cooperate<\/h3>\n\n

            The Client undertakes to:<\/p>\n\n

              \n
            • provide all necessary packaging specifications<\/li>\n\n
            • provide information regarding materials and legal requirements<\/li>\n\n
            • inform the Contractor immediately of any changes<\/li>\n<\/ul>\n\n

              \u00a77 Provision of Data<\/h3>\n\n

              (1) Within its operational capabilities, the Contractor shall provide information regarding packaging types and quantities.<\/p>\n\n

              (2) Unless separately agreed, there shall be no entitlement to detailed evaluations, certifications, or statutory reporting.<\/p>\n\n

              \u00a78 Final Provisions<\/h3>\n\n

              (1) Should any provision of these regulations be or become invalid, the validity of the remaining provisions shall remain unaffected.<\/p>\n\n

              (2) German law shall apply.<\/p>\n\n
