§1 Scope of Application

These provisions apply to all logistics services provided by
Logistik Centrum Hamburg Hinderer GmbH & Co. KG (hereinafter referred to as the “Contractor”), in particular:

1. Warehousing
2. Transport logistics
3. Shipping services
4. Value Added Services (VAS), such as repacking, co-packing, and re-packaging

§2 Packaging Responsibility

(1) The Client is responsible for compliance with all legal requirements relating to packaging, in particular pursuant to the Packaging and Packaging Waste Regulation (PPWR).

(2) This includes in particular:

1. the recyclability of packaging
2. compliance with material requirements
3. labeling and information obligations
4. requirements regarding minimization and reusability

§3 Performance of Packaging Services

(1) Packaging services provided by the Contractor shall be performed exclusively:

1. based on the Client’s specifications; or
2. using the Contractor’s standardized packaging solutions.

(2) If no explicit Client specifications are provided, the Contractor shall be entitled to use suitable standard packaging at its own discretion.

§4 Liability

(1) Responsibility for the legal compliance of the packaging shall remain with the Client unless expressly assumed by the Contractor in written form.

(2) The Contractor shall not be liable for:

1. the legal admissibility of packaging
2. the Client’s compliance with statutory packaging regulations
3. incorrect or incomplete Client specifications

§5 Value Added Services (VAS)

(1) Services such as:

1. repacking
2. re-packaging
3. co-packing
4. kit assembly

shall be performed exclusively on the basis of the Client’s specifications.

(2) In the absence of such specifications, the Contractor assumes no responsibility for packaging compliance.

§6 Client’s Duty to Cooperate

The Client undertakes to:

1. provide all necessary packaging specifications
2. provide information regarding materials and legal requirements
3. inform the Contractor immediately of any changes

§7 Provision of Data

(1) Within its operational capabilities, the Contractor shall provide information regarding packaging types and quantities.

(2) Unless separately agreed, there shall be no entitlement to detailed evaluations, certifications, or statutory reporting.

§8 Final Provisions

(1) Should any provision of these regulations be or become invalid, the validity of the remaining provisions shall remain unaffected.

(2) German law shall apply.
